Terms of Service

1. Agreement to Terms

By accessing or using MagicDay ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you ("User") and MagicDay ("we", "us", or "our"). These Terms are governed by Brazilian law, including the Consumer Protection Code (CDC - Lei 8.078/1990) and the General Data Protection Law (LGPD - Lei 13.709/2018).

2. Definitions

For purposes of these Terms:

  • "Platform" means the MagicDay web application, including all pages, features, content, and services accessible through it.
  • "User" means any individual who accesses, registers for, or uses the Platform.
  • "Content" means all text, images, guides, templates, checklists, itineraries, and other materials provided through the Platform.
  • "User Data" means any information entered by the User into the Platform, including trip details, itinerary entries, checklist progress, shopping lists, optional shopping value estimates, and packing lists.
  • "Service" means the digital trip planning tools and content provided through the Platform.

3. Service Description

MagicDay is a digital trip planning platform that helps users organize and plan their Orlando theme park vacations. The Platform provides planning tools including a dashboard, itinerary builder, trip timeline guidance, checklists, packing lists, shopping lists, bonus content, and park guides. Access to the Platform is granted through a one-time purchase that provides lifetime access.

IMPORTANT: MagicDay is NOT a travel agency, tour operator, or booking service. We do not sell tickets, make reservations, or arrange transportation or accommodation. MagicDay is NOT affiliated with, endorsed by, or sponsored by The Walt Disney Company, Universal Studios, or any theme park operator. All park names, logos, and trademarks mentioned on the Platform belong to their respective owners and are used solely for informational reference.

4. Account Registration and Access

To access the Platform, you must complete a purchase and create an account. During purchase, you provide your name, email address, phone number, and, for payments in Brazil, CPF (tax ID) and billing address when required by the selected processor. An initial password is sent to you via WhatsApp and/or email. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. License Grant

Upon completing your purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content for your personal, non-commercial trip planning purposes. This license covers all features available on the Platform, including the dashboard, itinerary builder, trip timeline guidance, checklists, packing lists, shopping lists, bonus content, and park guides. This license does NOT constitute ownership of the software, Content, or any intellectual property rights therein.

6. Payment and Pricing

Access to MagicDay requires a one-time payment. The price is displayed at checkout and may vary by region and currency. Payments are processed securely through third-party payment processors (Stripe for international payments and AbacatePay or Pagar.me for payments in Brazil, including PIX and credit card). We do not store your full payment card details. There are no hidden fees, subscription charges, or recurring payments.

7. Right of Withdrawal (Cooling-Off Period)

In accordance with Article 49 of the Brazilian Consumer Protection Code (CDC - Lei 8.078/1990), you have the right to withdraw from your purchase within 7 (seven) calendar days from the date of purchase, for any reason, without penalty. This is an unconditional right guaranteed by Brazilian law.

To exercise your right of withdrawal, contact us within the 7-day period via email at [email protected] or WhatsApp at +55 61 99514-0579. Include your name, email used for purchase, and order number. Upon confirmation, a full refund will be processed within 15 (fifteen) business days using the same payment method used for the original purchase.

8. Refund Policy

Beyond the 7-day statutory right of withdrawal described above, we also offer a 30-day money-back guarantee. If you are not satisfied with the Platform within 30 days of purchase, you may request a full refund by contacting us at [email protected] or +55 61 99514-0579. Refunds will be processed within 15 (fifteen) business days.

9. User Content and Data

You retain full ownership of all User Data you enter into the Platform, including your trip information, itinerary entries, checklist progress, shopping lists, optional shopping value estimates, and packing lists. By using the Platform, you grant MagicDay a limited, non-exclusive license to process your User Data solely for the purpose of providing the Service to you. We will not sell, share, or use your User Data for any purpose other than delivering the Service, as detailed in our Privacy Policy.

10. Intellectual Property

All Platform Content - including but not limited to park guides, travel tips, bonus materials, templates, itinerary structures, design elements, logos, and source code - is the exclusive intellectual property of MagicDay and is protected by Brazilian and international copyright laws. Users may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform Content without our prior written consent.

11. Prohibited Uses

You agree not to:

  • Share, resell, or distribute your account credentials or access to the Platform with any third party.
  • Copy, scrape, download, or extract any Platform Content for redistribution or commercial purposes.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to interfere with, compromise, or disrupt the Platform's security or infrastructure.
  • Use automated tools (bots, scrapers, crawlers) to access the Platform.

12. Service Availability and Modifications

The Platform is provided on an "as is" and "as available" basis. While we make reasonable efforts to maintain uptime and functionality, we do not guarantee uninterrupted or error-free access. We reserve the right to update, modify, add, or remove features and content at any time to improve the Platform. Material changes will be communicated to users via email or through the Platform.

13. Third-Party Services

The Platform relies on third-party services for its operation, including:

  • Stripe - Payment processing (https://stripe.com/privacy)
  • AbacatePay - Hosted checkout for payments in Brazil (https://abacatepay.com/politica-de-privacidade)
  • Pagar.me - Payment processing in Brazil via PIX and credit card (https://pagar.me/privacy-policy/)
  • Supabase - Database and authentication (https://supabase.com/privacy)
  • Twilio - WhatsApp notifications (https://www.twilio.com/legal/privacy)
  • Vercel - Website hosting (https://vercel.com/legal/privacy-policy)
  • Resend - Email delivery (https://resend.com/legal/privacy-policy)
  • PostHog - Product analytics and session replay (https://posthog.com/privacy)

Your use of the Platform is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices or content of third-party services.

14. Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Platform in a manner that harms other users or our operations. You have the right to request account deletion at any time by contacting us at [email protected]. Before deletion, you may request a copy of your User Data in accordance with your rights under the LGPD (see our Privacy Policy). Upon account deletion, your User Data will be removed in accordance with our data retention policy.

15. Limitation of Liability

To the maximum extent permitted by applicable law, MagicDay's total liability to you for any claims arising from or related to the Platform shall not exceed the amount you paid for access. MagicDay shall not be liable for any indirect, incidental, special, consequential, or punitive damages. MagicDay is not responsible for outages or failures of third-party services. Force majeure events relieve us of liability during their duration.

IMPORTANT: MagicDay provides planning tools and informational content only. We are NOT liable for any travel decisions, reservations, purchases, or experiences made based on information or suggestions provided through the Platform. All travel planning decisions are made at your own discretion and risk.

16. Disney and Theme Park Disclaimer

MagicDay is an independent trip planning tool. We are NOT affiliated with, endorsed by, or sponsored by The Walt Disney Company, Walt Disney World Resort, Disneyland Resort, Universal Studios, NBCUniversal, Comcast Corporation, or any of their subsidiaries, affiliates, or theme park operators. All theme park names, attraction names, character names, logos, and trademarks mentioned on the Platform are the property of their respective owners and are used solely for informational and reference purposes.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. In accordance with Article 101, I of the CDC, any disputes arising from these Terms shall be submitted to the jurisdiction of the consumer's domicile (foro do domicílio do consumidor).

18. Changes to These Terms

We may update these Terms from time to time. Changes will be communicated via email and/or through the Platform, and the "Last updated" date above will be revised. Your continued use of the Platform after changes are communicated constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may request account deletion and a refund if within the applicable refund period.
